Welcome to SharedAccessCommons ("we," "our," or "us"). These Terms & Conditions ("Terms") regulate your interaction with our yacht charter services and our online presence at sharedaccesscommons.sbs (the "Service") which is facilitated by SharedAccessCommons.
By reserving a charter or employing our Service, you consent to these Terms. If any aspect of these Terms is unacceptable to you, you are not permitted to access the Service.
2. Service Overview
SharedAccessCommons offers high-end yacht charter services that comprise, but not limited to:
- Daily yacht rentals
- Sunset cruises
- Business getaways
- Exclusive gatherings
- Extensive charters
Availability of services depends on various factors, including weather conditions. We maintain the authority to adjust or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
In order to reserve a charter, you must:
- Have attained at least 18 years of age
- Submit precise and comprehensive details
- Make the necessary deposit as outlined in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking is deemed confirmed solely after payment is made and our written authorization is provided. We reserve the authority to decline service at our discretion.
3.3 Availability
Charter availability is linked to vessel accessibility and appropriate weather conditions. We'll endeavour to meet your requested dates and timing.
4. Payment Terms
4.1 Pricing
All fees are presented in € and encompass all relevant taxes unless declared otherwise. Prices can change without previous notification.
4.2 Payment Schedule
- Initial deposit: 50% of the total charter cost payable upon booking
- Final balance: Due 48 hours before the charter's start
- Additional fees (if applicable): To be settled after the charter concludes
4.3 Payment Methods
We accept widely-known credit cards, electronic bank transfers, and certified cheques. Secure, encrypted solutions handle our payment processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Ahead of 72 hours from departure: Full reimbursement minus service fees
- Between 24 to 72 hours before departure: Half of the cost refunded
- Inside 24 hours of departure: No reimbursement provided
5.2 Weather Cancellations
If weather circumstances are considered perilous by our captain, options presented include:
- Rescheduling the charter to a subsequent available slot at no extra charge
- Issuing a complete refund if rescheduling is not feasible
5.3 Mechanical Complications
Should mechanical issues arise with the designated vessel, we will endeavour to provide an acceptable replacement. If this isn't possible, we'll issue a full reimbursement.
6. Safety and Conduct
6.1 Safety Requirements
Every guest is required to:
- Adhere to all instructions from the crew
- Utilize provided safety equipment when necessary
- Communicate any health conditions that may impact their safety
- Stay within the designated areas on the ship
6.2 Prohibited Objects
Certain items are barred from the yacht, including:
- Large glass vessels
- Unlawful materials
- Arms or weapons
- Excessive quantities of non-alcoholic beverages
- Pets (except with prior consent)
6.3 Behaviour
Visitor behaviour must be respectful at all times. We hold the right to terminate a charter prematurely without reimbursement if a guest's conduct is unsafe or disrupts others' experiences.
7. Liability and Insurance
7.1 Our Liability
Our responsibility is limited to the cost of your charter. We are not accountable for:
- Self-inflicted harm due to passenger carelessness
- The loss or destruction of private belongings
- Unforeseen, resulting, or penalizing liabilities
- Delays due to weather or circumstances outside of our control
7.2 Insurance Policy
We have inclusive marine insurance that protects our fleet and operations. It is the passenger's duty to arrange their own travel and personal indemnity coverage.
7.3 Acceptance of Risk
By partaking in our charters, you are aware that sea-based actions come with inherent dangers, and you accept accountability for your own safety and protection.
8. Adjustments and Itinerary Alterations
We hold the right to alter travel plans, paths, or timetables based on considerations such as weather, safety, or operational demands. We aim to offer comparable substitute experiences whenever feasible.
9. Force Majeure
We are not culpable for postponements, cancellations, or changes induced by situations outside of our sway, such as but not restricted to:
- Severe meteorological events
- Natural calamities
- Governing ordinances
- Harbour closures
- Mechanical failures
10. Data Protection and Privacy
Your private details are managed in congruence with our Privacy Policy. By utilizing our services, you agree to the gather and usage of your data as detailed in the aforementioned policy.
11. Intellectual Property Rights
Our website's content, including text, imagery, logos, and trademarks, is safeguarded by copyright and trademark regulations. Unauthorized reproduction, dissemination, or alteration of works are not permitted without our explicit consent.
12. Jurisdiction and Governing Law
These Terms are governed by the laws in force in Germany. Legal disputes are to be settled in courts located at Hamburg, Germany.
13. Revisions to Terms
